I came across a letter that appears to have been authored by Dr Adam Tomison, Director General, Dept of Justice in Perth WA. The letter can be read here - https://www.larryhannigan.com.....au/government-federa
In part it reads:
3rd Paragraph:
"The Commonwealth of Australia Constitution Act (the Constitution) came into effect in 1901. It is the fundamental law of Australia binding everybody including the Commonwealth Parliament and the Parliament of the states. An act Passed by a Parliament is invalid if it conflicts with the Constitution"
4fth Paragraph:
"The Constitution describes the composition, role and powers of the Australian Parliament. This includes how the Commonwealth and states share the power to make laws. The Constitution also details some of the rights of Australian citizens, for example - the right to religious freedom. The Constitution can only be changed with the approval of the Australian people, by referendum.
'The Kabal Principle' - In 1996 a full High Court in the case: Kavle v the DPP (Director of Public Prosecutions) State of NSW HCA 24. A four judge majority stated, as Gaudron J stated at 14:
"Once the notion that the Constitution permits of different grades or qualities of justice is rejected, the consideration that State courts have a role and existence transcending their status as State courts directs the conclusion that Ch III requires the Parliaments of the States not legislate to confer powers on State courts or authorise the State Courts to make Rules, which are repugnant to or incompatible with their exercise of the judicial power of the Commonwealth".
